Insurance 101: Do I Need to Request a W-9 from My Insurance Agent to Issue a 1099-NEC?

In most cases, no, you do not need to request a W-9 from your insurance agent to issue a 1099-NEC. Here’s why:

Insurance Premiums Are Not Reportable
Payments made for insurance premiums are not considered taxable income to the agent or broker. Since these payments go toward coverage provided by the insurance carrier, they do not require a 1099-NEC.

The Agent Acts as a Pass-Through
Your insurance agent or broker typically collects premiums on behalf of the insurance carrier. Because they are not the ultimate recipient of the funds in a way that classifies as taxable income, you are not required to issue a 1099-NEC to them.

When a 1099-NEC Might Be Required
If you pay your insurance agent directly for non-premium-related services (such as consulting, risk management advice, or other professional services) and those payments total $600 or more in a calendar year, you may need to issue a 1099-NEC for that compensation. In that case, requesting a W-9 would be appropriate.
